By accepting a quote, you agree to these terms of service. Acceptance of a quote can be verbal, in writing, or by payment of the initial deposit.
1. Quotes and Additional Charges
All quotes are estimated based on the time needed to fulfil your requirements. Any additional pages, booking systems, or extras that were not agreed upon before a quote has been accepted may incur an additional charge. It is therefore paramount that clients provide us with clear guidelines to avoid additional costs.
2. Development and Fixes
Any issues encountered with the website during or just after development due to our error will be fixed free of charge.
3. Hosting Services
We offer free hosting for 1 year after a website goes live to clients who have purchased our full website design package. This offer does not apply to clients only purchasing website edits. Our hosting services include server management, security monitoring, regular backups, and technical support to ensure your website runs smoothly.
4. Client Satisfaction
We promise our clients that websites are not complete until they are 100% satisfied with the product. By approving a website to go live, you are accepting that you are 100% satisfied and payment will be due.
5. Transfer of Rights
Once a website is live, all rights to the website are transferred completely to the client upon payment. However, if websites are hosted on one of our servers, we must be notified of any future plugins a client would like to install on their site before doing so to prevent any security compromises to our servers.
6. Payment Terms
We require a 50% deposit of the full price to begin an agreed service for our clients. The final 50% payment is due as soon as a website is made live, with the exception of any different payment plan we have agreed on. We accept payment via bank transfer or PayPal. An invoice will be issued to clients detailing how to pay. We do not accept cash payments.
7. Maintenance and Warranty
8. Disclaimer of Liability for Downtime
While we strive to offer the highest level of service availability, Levitate Online LTD is not liable for any loss, damage, or inconvenience caused by any temporary or extended downtime, technical issues, or any other disruptions that may affect your website’s availability. This includes, but is not limited to, financial losses, loss of data, or loss of business opportunities.
9. Service Interruptions Scheduled maintenance, server updates, or unforeseen technical difficulties may occasionally result in temporary service interruptions. We will endeavour to inform you in advance of any scheduled downtime to minimise inconvenience.
10. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Levitate Online LTD, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Service; (ii) any unauthorised access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the Service; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Service by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service; and/or (vi) the defamatory, offensive, or illegal conduct of any third party.
11. User Responsibilities
As a user of our hosting and maintenance services, you are responsible for maintaining the security of your account and website, including keeping your passwords secure and ensuring your website content complies with all applicable laws and regulations.
12. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
